Has anyone here tried changing the year of birth in their birth certificate after it was already registered? I recently found a mistake in mine and I’m wondering if it’s even possible to get it corrected now. What’s the proper process for this, and do I need a court order or can it be done directly through the municipal office?
Can I change the year of birth in my birth certificate after registration?
Yes, you can correct the year, but only if you can prove that the registered date is wrong and that the new date is your actual date of birth. The process is longer than a spelling fix and usually needs strong old proof plus a court order in most Indian states.
What the rule says
- Under the Registration of Births and Deaths Act, no entry can be altered after one year except to correct a clerical error.
- A change of year is treated as a correction of fact, not a clerical change, so you must convince the Registrar that the original entry was wrong.
Normal steps inside India
- Collect old proof – hospital discharge slip, first school admission form, immunisation card, prenatal clinic card, or any document created before age seven that shows the correct year.
- Affidavit – swear a notarised affidavit stating the correct year and the reason for the mistake.
- Paper publication – publish a small notice in two local newspapers stating the proposed change so the public has a chance to object.
- Court order – file a civil suit or miscellaneous petition in the district court asking for a direction to correct the birth register. Attach all old proofs, the affidavit, and the newspaper clippings.
- Apply online or at the municipal office – once you receive the judge’s order, log in to your state CRS portal (or visit the ward office) and upload:
- Certified copy of the court order
- Original birth certificate (for cross-check)
- Online fee receipt
- Any other document the registrar asks for
- Download the corrected certificate – the portal will show the new birth year and carry a small note “Corrected as per Court Order dated …”.
Remember
- You cannot move the birth after the registration date (e.g., you cannot claim a date that is later than the day the certificate was first made).
- If the difference is only 1–30 days within the same year, many states allow it with two old proofs and without a court order, but the final call rests with the District Registrar.
So, if you have strong old documents and are ready for a small court process, the year can be changed even after many years of use.
